Terms of Service

These Terms of Service ("Terms") govern your use of the SendEmAll platform and services ("Service") operated by SendEmAll ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using SendEmAll, you confirm that you are at least 18 years old, have the authority to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Account Registration
- You must provide accurate and complete information when creating your account
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access to your account
- One person or entity per account unless on an Enterprise plan with sub-accounts
- We reserve the right to suspend or terminate accounts that violate these Terms
3. Credits & Billing
Plans and pricing
SendEmAll offers the following subscription plans:
- Trial: $0 — 100 one-time credits (~13 potential buyers reached)
- Pro: $149/mo — 15 managed mailboxes, 1,500 credits (~200 potential buyers reached)
- Business: $349/mo — 45 managed mailboxes, 5,000 credits (~650 potential buyers reached)
- Scale: $599/mo — 105 managed mailboxes, 15,000 credits (~2,000 potential buyers reached)
- Enterprise: Custom pricing — 150+ managed mailboxes, custom credits
Credits
One credit equals one action within the platform (e.g., one lead discovered, one email verified, one email sent, one personalization generated). Credits are consumed as actions are performed and are non-refundable once used.
Pay-as-you-go overage
If you exceed your plan's monthly credit allocation, additional credits are billed at the following per-credit rates:
- Pro: $0.05 per credit
- Business: $0.04 per credit
- Scale: $0.03 per credit
Billing cycle
Subscriptions are billed monthly. Unused credits do not roll over to the next billing period. You may upgrade or downgrade your plan at any time; changes take effect at the start of the next billing cycle.
4. Acceptable Use
You agree to use SendEmAll only for lawful purposes. Specifically, you must:
- Comply with the CAN-SPAM Act, GDPR, CASL, and all other applicable anti-spam and privacy laws
- Only contact individuals who have not opted out of receiving communications
- Include a valid physical mailing address and a clear unsubscribe mechanism in every email
- Not send deceptive, misleading, or fraudulent content
- Not use the platform to send malware, phishing, or other malicious content
- Not harvest email addresses for the purpose of spamming
- Not resell or redistribute access to the platform without authorization
- Not interfere with or disrupt the platform's infrastructure or other users' access
- Not attempt to circumvent sending limits, credit allocations, or Smart Ramp-Up protocols
Violation of this Acceptable Use policy may result in immediate account suspension or termination without refund.
5. Data & Privacy
Your use of SendEmAll is also governed by our Privacy Policy. You retain ownership of the data you upload to the platform. We process your data solely to provide the Service. You are responsible for ensuring you have the legal basis to process any personal data you upload or generate through the platform.
6. Reply Guarantee
The Reply Guarantee is available exclusively on Business and Scale plans and is subject to the following terms:
- If you receive fewer than 50 qualified replies within your first 90 days of active campaigning, you are eligible for bonus credits
- A "qualified reply" is defined as a genuine response from a unique potential buyer, excluding bounces, out-of-office messages, and unsubscribe requests
- To be eligible, you must have actively run campaigns for at least 60 of the 90 days, followed platform best practices, and maintained acceptable sending patterns
- Bonus credits are issued at our discretion and are applied to your account for future use
- The guarantee applies once per account during the initial 90-day period
- Accounts flagged for Acceptable Use violations are not eligible
7. Managed Infrastructure
SendEmAll provides managed email sending infrastructure including domains, mailboxes, and Smart Ramp-Up protocols. We manage this infrastructure on your behalf and reserve the right to modify infrastructure configurations to maintain deliverability and comply with email provider policies.
8. Intellectual Property
The SendEmAll platform, including its software, design, logos, and documentation, is owned by SendEmAll and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.
You retain all rights to your content, including campaign copy, lead lists you upload, and data you export from the platform.
9. Termination
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of your current billing period
- We may suspend or terminate your account immediately for violations of these Terms
- Upon termination, your access to the platform ceases and your data will be retained for 30 days before deletion, unless otherwise required by law
- No refunds are provided for partial billing periods or unused credits
10. Limitation of Liability
To the maximum extent permitted by law, SendEmAll and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to SendEmAll in the 12 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
11. Indemnification
You agree to indemnify and hold harmless SendEmAll from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email or a prominent notice on the platform. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
